Assam Act III of 1942
An Act to amend the Assam (Temporarily Settled Districts') Tenancy Act, 1935
Preamble:- Whereas it is expedie nt to amend the Assam (Temporar ily Settled Districts) Ten ancy Act, 1935, in the manner hereinafter app earing ;
And whereas the Governor of Assam, has assumed to himself under the Proclam ation date d the 25th December 1941 issued by him under section 93 of the Government of India Act, 1935, all powers vested by or under the said Act in the Provincial Legislature ;
Now, therefore, in exercise o f the said powers, the Governor of Assam is pleased to make the following A ct :—
1. Short title, extent and commencement:- (1) This Act may be called the Assam (Temporar ily Settled Districts) Tenancy (Amendmen t) Act, 1942.
(2) It shall come into force at once .
(3) It shall have the like extent as the Assam (Temporarily Settled Districts) Tenancy Act, 1935, herein after referred to as the said Act.
2. Amendment of heading of Chapter IX of Assam Act II I of 1935:- In the heading of Chapte r IX of the said Act, for the words “ PRIVILEGED Raiyat AND OCCUPANCY Raiyats” the word “ TENANTS” shall be substituted.
3. Amendmen t of section 79 of A ssam Act II I of 1935:- In sub-section (1) of section 79 of the said Act for the words “ privileged raiyats and occu pancy raiyats” the words “ all or any class or classes o f te nants” shall be substituted.
4. Amendmen t of section 80 of Assam Act II I of 1935:- In section 80 of the said Act—
(t) for clause (a) the following shall be substituted, namely—
“ (a) the nam e of each tenant ’’ ;
(ii) (1) for the word "raiyat” in clause (ft) the word “ tenant” shall be substituted ;
(2) for the word “ raiyat” in clause (e) the word “ tenants shall be sub stituted ;
(3) for the word "raiyat's” in clause (rf) the w ord “ tenants shall be substituted.
5. Amendment of section 84 of Assam Act III of 1935:- In sub-sections (1) and (3) of section 84 of the said Act, for the words “ privileged raiyats and occupanc y raiyats” the words “ and tena nts” shall be sub stituted.
6. Amendment of section 85 of Assam Act III of 1935:- In section 85 o f the said Act for the words “ privileged raiyats and occupancy raiyats” the words “ tenants o f any class or classes” shall be substituted.
